Prayer Back in Style at Hawaii Senate

Prayer was banned from official proceedings in the State Senate two years ago after the Hawaii Citizens for the Separation of State and Church and the American Civil Liberties Union threatened to sue the legislature.

For decades, Hawaii Senators took turns offering prayers, poems, songs or thoughts for the day at the beginning of each floor session, or they invited guests to do the same in their place, and there was never an issue.

However, in January 2011, the Hawaii State Senate ended its practice because of the legal threats.

The House Speaker, who was faced with the same threat, continued on with daily prayer -- and was never was sued.

Now under new leadership of Senate President Donna Mercado Kim, the Senate will once again allow prayer before the floor session opens.

The first prayer will be offered on Thursday and participation by Senators will continue to be optional.

Tide Turns for?Public Land Development Corporation

The creation of the Public Land Development Corporation or the PLDC in 2011 has been one of the most controversial issues among Hawaii activists.

The PLDC, which operates under the Department of Land and Natural Resources, is charged with the task of developing state land to generate revenue and the board was given the ability to fast track development with minimal public input.

Many concerned environmental groups and activists have called on the legislature and the governor to dissolve the organization. In his opening day remarks, Senate Minority Leader Sam Slom also called for PLDC?s repeal.

But there has been strong resistance from Gov. Neil Abercrombie and some legislative leaders.

However, with the protesters getting louder and more effective, key legislators who once supported the PLDC will work to nix the agency.

Legislators say it is likely that by the end of the 2013 session, the controversial Public Land Development Corporation will be just a memory.

House GOP Leaderships' Surprising Response?

Republicans in the Hawaii State House have annually pledged to oppose all new tax increases.?But this year under newly elected Rep. Aaron Ling Johnason, the House?s seven Republicans have softened that position.

In response to a Hawaii Reporter inquiry, Johanson said the House Republicans would not take a unified stance against all new tax hikes.

Instead he said the House GOP will thoughtfully consider the real impact that any tax burden would place on low-income residents, working families and small businesses.

House Republicans helped put House Speaker Joe Souki in power this year, and have been assigned three vice chairmanships in exchange. They also supported the considerably more liberal faction of the House Democrats over the more fiscally conservative Democrats who were previously in power.

Despite the GOP's low numbers (7 of 51 House seats), their decision to support or oppose tax increases could make a difference for the taxpayers.

We mentioned earlier today that 49ers wide receiver Randy Moss declared himself the best wideout in the history of the game.

You?ll likely see much more about him in the coming days, in many outlets, because he was so open and forthcoming and illuminating about many topics during his appearance at Media Day.

When Moss is on, he?s extremely interesting, he just chooses not to be on often.

But among the gems today was a candid admission that he didn?t particularly care for the way the 49ers used him this year.

In the past, it could have been a Keyshawn-level ?Just Give Me the Damn Ball? routine, but Moss said it so matter-of-factly it was easy to miss.

?I don?t like my role; I don?t,? he said. ?I like to be out there playing football. One thing that I?ve always had to really understand was being a decoy. It was put to me, Coach Dennis Green just said, ?Even though the football is not in your hand, you?re still out there dictating how the defense is playing the offense.? It took me awhile to really understand where he was coming from. Later on and now in my career, I understand that my presence out on the field, I don?t always have to touch the ball to be able to help the offense score touchdowns.

?Like I said, I don?t really like that, but it?s something that I?m used to. I have to grow to understand and grow to like it. I?ve always been a team player. I?ve never been about self. Anything that is going to push our team to victory and hopefully win a Super Bowl, I?m willing to do.?

No, that was Moss, who hasn?t always been accused to giving freely of himself for the greater good.

But 49ers offensive coordinator Greg Roman said Moss had been nothing but professional.

?He?s been great,? Roman said. ?I think he?s a great team player, and a mentor for all the guys, really.?

His love of competition has never been in doubt. Moss joked about past arguments, even fights, he?s had with coaches and players. But his role with the 49ers, as much as he might not like it, remains a valuable one, as Roman insisted Moss could still ?get behind a defense in a hurry.?

?When I hear people talk about how talented I am and how easy I make it look, I can honestly tell you people that it?s very hard work,? Moss said. ?I work out five times a week. I put the work in and for me to be able to go out there and have results it something I am proud of. It?s not always the individual results that I?m proud of. For me to be able to talk to a Michael Crabtree or talk to a Frank Gore or Percy Harvin and for them to go out there and have a good game that week, that?s something I can be proud of. That?s just me giving back to the NFL.

?I?ve always said, I don?t like what the NFL does for me because I?m very blessed. My family is blessed. I?ve always been the type of person to know what I can do to make the League better. At this point in my career, if I?m able to be vocal, to share a little knowledge and also to go out there and play, if that?s what it takes to win a championship, then I?m willing to do that. I?ve always been that way.?

Maybe so, but he hasn?t been quite the way he was Tuesday too often, or the perception of his career would likely be very different.

NASA's RASSOR excavator robot shapeshifts to haul lunar soil, help make fuel and water

NASA believes our return to the Moon could be sustained by extracting water from the lunar soil to produce air and even fuel. But how to get large amounts of that soil without bringing heavy, failure-prone machinery? The agency's RASSOR (pronounced "razor") excavator robot might do the trick. Rather than wield big scoops, it has a pair of arm-mounted drums that can change the robot's profile and dig with far more efficiency than RASSOR's 100-pound weight would usually allow, using one drum as a grip. The robot's sheer flexibility is also key to its working for the estimated five years of NASA's plans: if the crawler ever overturns or gets caught, it can flip over and keep the main treads out of the ground while clearing out soil-related jams. There's enough refinement needed that a RASSOR 2 follow-up should be in testing around early 2014, but the sequel will be close enough to the ideal design that long-term Moon missions could have the little hauler as a passenger.

Mexican church sparks debate on forgiving killers

(AP) ? An order of Roman Catholic priests in Mexico has produced a video urging relatives of drug cartel victims to adopt a Christ-like forgiveness by pardoning even the killers, hitting a sensitive nerve in a country that has suffered an estimated 70,000 estimated drug gang killings or more.

The 10-minute video entitled "Brother Narco," presented this week, tells the story of Miri, a 13-year-old girl who cowers in her bedroom as a gunman and his gang kill her parents one night. The killer in a black cowboy hat later bursts with his henchmen into the church where her parents' funeral is being held. The gunmen carry a funeral wreath for the couple, and the killer lays a hand on the coffin, and then turns to leave.

Miri walks up to him in the church and hugs him.

"My uncles and aunts told me .... that when I grow up, I have to do the same thing to your children," Miri says to him, speaking of revenge. Instead, she decides to forgive him, reasoning, "Maybe somebody did the same thing to your parents, or maybe they never hugged you."

The killer is shown returning the embrace, but it is unclear what he does next.

The scriptwriter of the short film, Pauline Father Omar Sotelo, said he won't reveal if the killer ever repents of his crime. Sotelo says his group is already in pre-production for the second of a planned 12 short features, filmed in high-definition video, which will be distributed on the Internet and on social networks.

Sotelo acknowledged that such a scene might be improbable in real life, but insisted that "as mystical and utopic as it may seem, this project comes out of real-life stories."

He told of one woman he met who decided to forgive her sons' killer.

"She said "I don't want to see anyone else's children killed. That is why I pardoned my son's killer'," Sotelo recalled.

Anti-crime crusader Isabel Miranda de Wallace had a different view: "I don't think people can forgive if they don't even know what happened to the victims, if justice hasn't been done."

Miranda de Wallace led a decade-long fight to bring to justice the gang that kidnapped and killed her son. But they haven't been sentenced yet, and they delayed so long in telling where they left her son's body that the lot was built over by the time authorities could search it.

She said even getting answers is hard in a country where drug gangs have routinely dissolved the bodies of their victims in chemicals or dumped them in unmarked mass graves.

"There are a lot of people who cannot even mourn, because we haven't found the bodies of our relatives, " she said, "so how are you going to go through the process of loss and reach forgiveness if you can't even get justice?"

To some extent, it is surprising how much tolerance victims' relatives have shown. In 2011, when victims banded together to form the Movement for Peace and Justice With Dignity, the relatives of dead drug gang suspects and the relatives of drug gang victims often marched and rallied side by side, to demand answers about their loved ones' fates.

Sotelo hardly thinks his production is the last word on the debate. But in a nation where tens of thousands of young men have been recruited to drug gangs, he said forgiveness is something the nation is going to have to deal with. The only other alternative would be to arrest or kill all of the gunmen, and ? apart from humanitarian concerns ? Mexican authorities haven't proven very capable at doing either.

"By attacking the criminals with guns, what we have done is taken violence and produced more violence," he said.

"What we have found is that these criminals have undergone a process of dehumanization," Sotelo said. "What we need to do is to reverse that process of dehumanization. How you re-humanize someone, is, well, by treating them as what they are, a human being."

Miranda de Wallace, too, acknowledged Mexico will one day face the task, but in a country where an estimated 98 percent of crimes go unprosecuted, said that day has not yet arrived.

"Without doubt, we will have to reach forgiveness," she said, "but I don't think we are at that stage yet in the national process."

UN humanitarian chief in Syria for talks

DAMASCUS, Syria (AP) ? The United Nations humanitarian chief was in Damascus on Sunday for talks with Syrian officials about the nation's conflict, which has forced millions of people from their homes, destroyed the country's cities and created food and fuel shortages.

Valerie Amos did not make any public remarks upon her arrival in Damascus on Sunday for a two-day visit, but at the World Economic Forum in Davos last week, she said world powers had not done enough to lessen Syrian suffering.

"The humanitarian situation in Syria is already catastrophic and it's clearly getting worse," she said. "What we are seeing now are the consequences of the failure of the international community to unite to resolve the crisis."

The U.N. says more than 60,000 people have been killed since the start of the conflict in March 2011.

Living conditions have deteriorated across Syria during the 22-month conflict, which began with political protests that escalated into a civil war with scores of rebel groups battling President Bashar Assad's forces. Entire towns and neighborhoods have been damaged in the fighting, and more than 2 million people are internally displaced, with another 650,000 seeking refuge in neighboring countries.

Some areas face food shortages, and even areas that have been spared large-scale violence like Damascus lack sufficient quantities of gasoline, heating oil and cooking gas.

On Friday, the U.N. announced it was preparing to send $10 million in new U.S. aid to help alleviate hunger in northern Syria.

World powers remain divided on how to solve the crisis. The U.S. and many Arab and European countries have called on Assad to step down, while Russia, China and Iran refuse any pressure from outside that seeks to hasten the regime's fall.

On Saturday, Iran made its strongest warning to date that it could intervene militarily to help Assad's regime.

As quoted by the semiofficial Mehr news agency, an aide to Iranian Supreme Leader Ayatollah Ali Khamenei said Syria held a key position among a group of Middle Eastern powers opposed to U.S. and Israeli influence in the region.

"Syria plays a very key role in supporting or, God forbid, destabilizing the resistance front," said Ali Akbar Velayati. "For this same reason, (an) attack on Syria is considered (an) attack on Iran and Iran's allies."

Iran is Syria's strongest ally in the Middle East, and has provided Assad's government with military and political backing for years. In September, the top commander of Iran's powerful Revolutionary Guard, Gen. Mohammad Ali Jafari, said the elite unit had high-level advisers in Syria. Iran also is believed to be sending weapons and money to Syria.

A senior Israeli Cabinet minister warned on Sunday that Israeli could attack sites in Syria if Assad's regime transferred chemical weapons to the Hezbollah militant group in Lebanon.

Vice Prime Minister Silvan Shalom confirmed to Israel's Army Radio that top security officials held a special meeting last week to discuss Syria's chemical weapons arsenal.

"It would be crossing a line that would demand a different approach, including even action," he said. Asked whether this might mean a pre-emptive attack, he said: "We will have to make the decisions."

Also on Sunday, Syria announced that it would drop legal proceedings against opposition figures who returned to the country to participate in a "national dialogue" called for by Assad during a recent speech.

Syria's Higher Judicial Council announced the decision in a statement carried by the state news agency. The report gave no further details.

Assad proposed the national dialogue as part of his plan to end the country's crisis as laid out in a high-profile speech this month at the Damascus Opera House.

In the same speech, however, he vowed to keep fighting and referred the opposition as criminals and terrorists ? making it unlikely anyone will take their chances on the amnesty offer.

Tens of thousands of activists, their family members and opposition supporters remain jailed by the regime, according to international rights groups.

Opposition leaders have repeatedly rejected any talks that include Assad, insisting he must step down.

Violence continued around Syria on Sunday. The Britain-based Syrian Observatory for Human Rights reported clashes and government airstrikes in neighborhoods east and south of Damascus as well as elsewhere. At least seven people died in attacks in the suburbs, and three others died after a shell landed in the city's southern Yarmouk district.

The group, which relies on contacts throughout Syria, also reported clashes near a train station in southwestern Qadam neighborhood where four rebel fighters and one woman were killed.

Japan to start 4K TV broadcast in July 2014 - Channels Television ...

The Japanese government is set to launch the world?s first 4K TV broadcast in July 2014, roughly two years ahead of schedule, to help stir demand for ultra high-definition televisions, the Asahi newspaper reported on Sunday without citing sources.

The service will begin from communications satellites, followed by satellite broadcasting and ground digital broadcasting, the report said.

The 4K TVs, which boast four times the resolution of current high-definition TVs, are now on sale by Japanese makers including Sony Corp (6758.T), Panasonic (6752.T) and Sharp Corp (6753.T). Other manufacturers include South Korea?s LG Electronics (066570.KS).

Japan?s Ministry of Internal Affairs and Communications had aimed to kick-start the 4K TV service in 2016. That has been brought forward to July 2014, when the final match of the 2014 football World Cup is set to take place in Brazil, the Asahi report said.

In Japan, the development of super high-definition 8K TVs is in progress, and the Ministry of Internal Affairs and Communications plans to launch the test 8K TV broadcast in 2016, two years ahead of schedule, it said.

The Biggest Thing That Happened in the Real Estate Market This ...

There was a huge real estate market development recently that surprisingly has attracted little media or market attention. But it will. It?s going to have a huge impact on our New York City real estate market because it affects the basics of how real estate financing works and how existing mortgages are serviced. What?s more, many peoples? intuitive reaction about how this will affect the market will be wrong. Here?s a summary of what?s happening and my analysis as an attorney active in real estate law, and actively representing buyers, sellers, developers, owners, and condo and coop associations, about what the impact is likely to be.

And for the really good news: this time the glass is (more than) half full!

Two weeks ago the newly minted Consumer Financial Protection Bureau (CFPC) started down a road that will lead to fundamental real estate change and an incredible impact on the real estate market throughout America. The CFPB proposed, and will be proposing more, ?rules? for mortgage lenders to prevent future ?risky mortgage lending? of the kind that contributed so mightily to the 2008 housing market collapse and the recession that followed, which still impacts the housing market and America?s economy.

Before I get into the proposed ?rules? I should say that though this will have a market impact right now, it won?t actually go into effect until at least January of 2014. Even then, the best bet is that the rules will be phased in probably over a seven-year period. Nonetheless, I think the impact will be immediate and almost universal.

The proposals aren?t for hard and fast rules ? they really create a sort of ?safe harbor? provision for lenders, and aren?t actually prohibitions. But what bank or mortgage lender would dares to not follow these ?rules?? If they go into effect next year, and I think you can be pretty certain they will, complying with these provisions will mean the resulting loans will be ?qualified mortgages.? That means the bank, mortgage company or other mortgage lender who follows the rules for ?qualified mortgages? will gain legal protection against being successfully sued by borrowers or those who would buy mortgages from the original mortgage issuer. Put another way, failure to issue qualified mortgages will virtually assure law suits because the failure to comply with the ?qualified? standards will become the road map for asserting claims.

Failure to use the ?qualified? provisions would be like committing malpractice in the lending business. It will certainly become an industry standard.

You might think mortgage bankers or others involved in the business of real estate lending would oppose more regulation. But you?d be wrong. Actually, after billions-and-billions in legal settlements, litigation costs and loads of claims still pending or lurking in the future, lenders in the mortgage business and especially those involved in packaging and selling mortgage backed securities are eager for the bright line rules the CFPB rules could provide. The prospect of a safe harbor where they can do business with little or no exposure to legal claims will likely induce greater lending.

It?s a safe bet the rules for ?qualified mortgages? will quickly become minimum standards for virtually all government loans and related programs. How can the federal government support, insure or back mortgages based on practices the CFPB claims are misleading, unfair or predatory? How can state or local governments? How could regulators not require these standards as a minimum for bundling mortgages to create mortgaged backed securities; and even if the regulators somehow didn?t require it, mortgage security buyers in the marketplace surely would.

Failing to comply will be like flying a flag for state attorney generals, federal prosecutors and consumer protection agencies loudly proclaiming ?come investigate me?.? Different tax treatment for mortgages that do not comply with the CFPB standards won?t be far behind. And that?s not attractive to anyone.

Why wait? And few in the industry will wait. Failure to adopt these ?best practices? immediately would put a mortgage lender, and their shareholders, in peril. So it?ll be a dramatic, almost universal, market-place impact and an immediate one.

So what are the new ?rules??

The new standards will do away with ?interest only? loans, curtail large up-front fees, limit ?balloon payments? and set standards for income-to-loan ratios in an effort to prove potential buyers seeking financing can actually afford the mortgages they are getting. The proposed rules adopt a very top debt burden limit of not-more-than 43% of gross income. The requirements absolutely guarantee no more so-called ?no docs? loans (loans without supporting document, which believe it or not were widespread even in the subprime market back in pre-recession 2008) if the lender wants the qualified certification that provides the safe harbor litigation protection.

The rules may require that loans be amortized over not more than 30 years, and many who have been following the process think there will eventually be proposed rules setting specific percentage down payment requirements. They may prohibit ?seller financing? based on longer amortization periods but with pay offs required in 3 to 7 years, or with significantly higher than market interest rates ? though the standards won?t be directly applicable to individuals who finance only one or a few ?deals? a year (though as an attorney I?d advise my clients to be very careful, and protective of their own interests, if they aren?t in compliance with these rules if they become the industry standard as I believe they will). ?Negative amortization? loans, amortized with very low initial payments and structured so that the borrower actually loses equity in the home early in the transaction, will probably be prohibited for ?qualified mortgages?.

The CFPB says about 75% of mortgage loans issued in 2011 would already have met the new ?qualified? provisions, but that?s largely because credit markets have been very tight, and requirements very strict, since the 2008 meltdown. Far, far fewer than 75% of the mortgages issued in 2007 would have complied.

Most consumer advocates have long claimed the practices being targeted by the CFPB were unfair, disreputable or bad practices that never should have been allowed. Kathleen Day, of the Center for Responsible Lending, hailed the new proposals and particularly called interest only and balloon payment loans ?predatory practices.? Guy Cecela, publisher of Inside Mortgage Finance Borrower, an industry publication, said no-interest loans were ?a recipe for disaster? and predicted a ?huge number of these? existing interest-only and balloon payment ?loans are going to default.?

The CFPB also adopted rules for mortgage service companies requiring them to issue clear monthly billing statements that indicate how much of each payment goes to principal reduction, interest and fees and requirements to warn borrowers well in advance of any payment increase due to automatic adjustments or rising interest rates. Mortgage servicers will also be required to promptly credit loan payments and swiftly correct errors, and be prohibited from pursuing foreclosure at the same time they are discussing loan modification with a borrower. They?ll also be more closely regulated to prevent abuses of so-called ?force insurance? premiums, where mortgage servicers place a borrower in a high premium insurance policy if they ?believe? a borrower?s required insurance coverage may have lapsed. The rules on mortgage servicers are also set to go into effect next January 1st.

Rather than further slow a tight credit market, these bright line rules aiming to create an industry standard are likely to loosen credit and allow more potential buyers to obtain mortgages. It?s likely to create more mortgage money in what has been an artificially tight credit environment, which will serve to kick-start real estate sales. Predatory mortgage practices will be gone, and good riddance to them; but money will begin to flow again to credit-worthy buyers to finance proper deals on fair terms. That?s a win-win outcome for mortgagors, mortgagees, the real estate market and the economy.

Happy Friday, fellow debt wranglers! ?I don?t know about you, but it has been a long week this week. ?I have been sleeping?sporadically (if you have a child, you know what I am talking about) and it is starting to affect my thought processes. ?I am usually one that people come to in order to solve problems at work. ?This is a job that I love, but lately, I feel that I have been slipping. ?Something that should take me a few moments to figure out is now taking me hours. ?I know that it is just due to the extreme lack of sleep, but it irritates me. ? On top of that, my wife told me today that she read in a couple of books that babies go through a crazy crying spell when they are about 6 weeks old. ?My son is turning one month old this Sunday, so I hope this is just not true. ?I don?t think I can take anymore crying!

On other news, Debt RoundUp is doing well. ?Traffic has remained steady with small, but incremental increases in traffic. ?I have been a little slow getting things done this week and I want to apologize to anyone that has asked me for something. ?I plan on catching up this weekend, but who knows.

A senior scientific advisory panel at the National Institutes of Health, in a step toward phasing out the use of chimpanzees in federally funded medical research,?has found "no compelling evidence" to support keeping hundreds of chimpanzees at NIH facilities and recommends that all but about 50 chimps be retired.

This small group would remain available as a contingency should some unforeseen disease emerge for which chimps would be the best stand-ins for humans. But they, along with the retirees, would be housed in facilities designed to more adequately accommodate the full range of normal chimp physical and social activities ? from climbing, foraging, and daily nest-building to hanging out in sizable groups on branches high off the ground, according to the panel.

The panel also recommends ending 16 of 30 research projects involving chimpanzees that the NIH currently is funding. The largest proportional hit falls on biomedical research, one of three categories of projects. Six out of nine current biomedical projects would end.

The ultimate driver behind the recommendations: concerns about the value and ethics of using chimpanzees, biologically the nearest relative to humans, for physically painful and intrusive infectious-disease research.

If the 28 recommendations are implemented, the effort would represent "an historic step forward" in moving chimps out of the lab and into sanctuaries, says Kathleen Conlee, vice-president for animal-research issues at the Humane Society of the United States, based in Washington.

Even foes of federal legislation to greatly restrict the use of chimps and other "great apes" in biomedical research see merit in the new recommendations.

As a stand-in for humans, "the chimpanzee has played a very important role in the evolution of biomedical research," notes Frankie Trull, president of the National Association for Biomedical Research (NABR) in Washington, which fought against the Great Apes Protection and Cost Reduction Act of 2011, which died in December with the end of the 113th Congress.

But biomedical science has advanced, Ms. Trull continues. And keeping chimpanzees is expensive; chimps are not euthanized but must be cared for until they die naturally. Researchers have found alternative animal models for some of the kinds of studies that once centered on chimps.

Although NABR opposed the Great Ape Protection and Cost Reduction Act, the group is comfortable with the recommendations the NIH is now considering, Trull says.

The case for change and the steps to take came from the scientific community, she observes, adding, "scientists should determine what animal models should be used, not Congress."

Chimpanzees represent a tiny proportion of animals used in biomedical research. The overwhelming majority of animals used are either rodents or zebra fish.

The recommendations represent the outcome of a process that began at the end of 2010, when three US senators asked the US National Academies to examine the issue, as did the NIH. A year later, the National Academies' Institute of Medicine released its report.

The 86-page report released for comment on Jan. 22 was pulled together by a senior working group that the NIH gathered to turn the Institute of Medicine's report into specific recommendations.

If adopted, the recommendations would apply only to NIH-owned chimps and those used in the course of NIH-funded research. Of 670 chimps the NIH owns or supports, 219 have been retired. Some 282 are research-ready. Another 169 have been labeled "research inactive," a kind of bridge category between the first two.

By some estimates, another 350 chimps would fall outside the purview of these recommendations because they are owned either by private pharmaceutical companies or by universities.

Indeed, the Human Society's Ms. Conlee suggests the Great Ape Protection Act is likely to be reintroduced this year to broaden restrictions to chimps not covered by the new recommendations.
